Welcome to Trademiq, your portal to educational excellence in trading. Your use of Trademiq and its content signifies your acceptance of personal responsibility for your actions and decisions.

This document, along with any referenced materials (collectively, “Terms”), constitutes a binding legal agreement between you, the user (“You” or “Student”), and Safegate Advisors SRL, operating as Trademiq (“We” or “Us”), the provider of Trademiq’s services.

Trademiq” refers to the educational content, products, and services accessible via https://trademiq.com (our primary website and your personalized account pages), along with any other future platforms we may offer.

“Related Persons” encompasses the leadership, management, employees, and agents of Trademiq, including its subsidiaries, affiliates, franchisees, and their respective personnel.

“Students” are individuals who have agreed to utilize Trademiq Services under our specified terms.

We reserve the right to modify these Terms without prior notification. Regularly review these pages for any changes, which will be effective upon posting and binding upon your continued use of Trademiq and its services.

Your continued use of Trademiq following any changes indicates your acceptance of the revised Terms. You are responsible for staying informed about these changes.

New features, products, or services introduced in Trademiq may have their own terms and conditions, which will supersede these Terms in case of conflict.

These Terms complement any Enrollment Agreement terms you may have agreed to. TRADEMIQ AND ITS SERVICES Trademiq offers access to several platforms including the main website https://trademiq.com, alongside other future sites for additional products and services. The extent of your access to Trademiq's features is based on the specific products and services you have subscribed to.

Our offerings encompass various online educational tools, such as live and recorded sessions, on-demand video content, along with a range of external and proprietary resources (collectively referred to as “Products and Services”). All these, along with any future services accessed via Trademiq, constitute the “Trademiq Services”.

 

USAGE AGREEMENT

Each time you engage with Trademiq Services, you are bound by the following terms:

 

Account Responsibility

Maintain the confidentiality of your login credentials and refrain from sharing them.

Accept responsibility for all activities conducted through your account.

 

Community Participation

Trademiq Services are for adult individual users. By accessing Trademiq, you confirm you are at least 18 years old (or comply with the Minor Release Form requirements if under 18).

Discontinue using Trademiq Services if you do not accept these terms.

As a Trademiq member, provide accurate and current details, maintain the security of your account, and accept personal responsibility for all activities under your account.

Trademiq is intended for individual use. If accessing on behalf of a legal entity, ensure you have the authority to agree to these terms and acknowledge that your involvement is not commercially driven.

We reserve the right to suspend access to Trademiq Services for any individual at our discretion to ensure a high-quality experience for all students.

 

Trademiq Service Usage Guidelines

To ensure a productive and respectful environment for all Trademiq members, users must agree to the following rules:

  1. Prohibited Content: Users must not post or make available:

Content that is harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or discriminatory.

Unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any form of solicitation.

Private information of third parties, including addresses, phone numbers, email addresses, social media handles, Social Security numbers, or credit card numbers.

Material containing software viruses or harmful computer code designed to disrupt the functionality of any software, hardware, or telecommunications equipment.

Content that encourages or provides instructions for criminal offenses, violates anyone's rights, or breaches any law.

Any information that you are legally prohibited from sharing, such as inside information or confidential data under contractual or fiduciary relationships.

 

Prohibited Actions:

Users must not:

Impersonate any person or entity, misrepresent your identity or affiliation with any person or entity.

Use or attempt to use another's account without authorization, or create a false identity on Trademiq.

Forge headers or manipulate identifiers to disguise the origin of any transmitted information.

Engage in any activity that could damage, disable, or impair Trademiq Services, or adversely affect its use by others.

 

Inappropriate Conduct: Actions that may lead to removal or termination of access include, but are not limited to:

Selling unlawful products or services through Trademiq Services.

Posting content that is obscene, excessively violent, harassing, or otherwise objectionable.

Advocatingpromoting, or encouraging violence against any entities or individuals, or providing information for such actions.

Posting content that damages our reputation or goodwill.

Violating others' intellectual property rights.

Failing to secure required permissions for protected works.

Deleting or altering copyright information without proper authorization.

Using Trademiq Services for libelous, defamatory, threatening, harassing purposes, or posting content likely to cause distress.

Introducing harmful code or viruses into Trademiq Services or over the internet.

 

By using Trademiq Services, users confirm their understanding and agreement to abide by these guidelines.

 

Trademiq Community Guidelines

As a member of the Trademiq community, you agree to engage with Trademiq and its services, including Blog Communities and the Trademiq club, under the following guidelines:

 

Golden Rule: Always treat others as you wish to be treated yourself.

Remember the Golden Rule: This needs no further explanation.

In Trademiq, users are expected to be honest, respectful, and humorous without crossing into rudeness or offensive language. Our interactions and contributions are intended to be positive and educational. We share ideas, information, successes, as well as failures, to help and learn from each other.

Trademiq is not a platform for irrelevant or inappropriate topics, political grievances, or content unrelated to trading. Avoid dominating discussions and be mindful of others’ opportunities to contribute.

Communication should be respectful and measured – avoid yelling (such as using ALL CAPS or excessive exclamation marks). Treat Trademiq as a respectful and dignified space, leading by example in both good and challenging times. We value your mature participation and ability to maintain a light-hearted approach.

 

Trademiq Club Guidelines

  1. The Trademiq Club was established as a community space for sharing ideas and experiences, meant solely for educational purposes.

  2. Opinions and contributions in the Club are personal and do not reflect the official stance or curriculum of Trademiq. Participation is voluntary, and financial or trading advice should not be given during Club sessions. All actions based on Club discussions are taken at your own risk.

  3. The Trademiq Club aims to be a safe, positive, and respectful educational community. Any inappropriate behavior may lead to a request to stop such actions or potential removal from the Club.

  4. Contributors to the Club, or any similar forum on Trademiq, are known as “Contributing Members” and are expected to uphold these community standards.

 

Trademiq Access and Liability Disclaimer

  1. License for Personal Use: Upon agreeing and adhering to the Terms, you are granted a limited, revocable, personal, non-transferable, and non-exclusive right to access and utilize Trademiq and its Services for personal purposes. This license restricts any collection, aggregation, copying, duplication, display, or derivative use of Trademiq and its Services for other purposes. Use of data mining, robots, spiders, or similar tools within Trademiq is strictly prohibited, except for general-purpose internet search engines and non-commercial public archives.   2. Service Availability: Trademiq and its services may occasionally be unavailable due to maintenance or other reasons. We bear no responsibility for any such unavailability and are not liable for any errors, omissions, interruptions, or other issues that may occur as a result.

  3. Technical Malfunctions: We are not liable for any technical issues related to telephone networks, computer systems, servers, providers, computer or mobile phone equipment, or software, including those due to internet traffic or technical problems.

  4. This includes any potential harm or damage to your or others' computer and mobile hardware or software related to or arising from the use or downloading of content in connection with Trademiq or its Services.

  5. Limitation of Liability: We will not be responsible for any loss, damage, injury, or death resulting from the use of Trademiq and its Services, any content posted, transmitted, or interactions between users, whether online or offline. In the United Kingdom, this clause is amended to not exclude liability for death or personal injury caused by our negligence, or for fraud, fraudulent misrepresentation, willful misconduct, or other liabilities that cannot be excluded or limited by law.

     

    Trademiq Content Guidelines

    User-Generated Content:

All content including posts, blogs, messages, texts, images, and videos uploaded to or linked from Trademiq by users is their sole responsibility.

By contributing content to Trademiq, you grant us a perpetual license to use, publish, and republish your content without any compensation. This includes for advertising, marketing, or educational purposes.

We do not control user-generated content and are not responsible for its nature. You may encounter content that is offensive or inappropriate. While we may occasionally monitor content and remove anything deemed inappropriate, we are not responsible for any user’s conduct.

 

Content from Other Websites:

Trademiq may contain links to independent external websites. We have no control over these external sites and are not responsible for their content.

You choose to follow external links at your own risk, and we make no guarantees about the accuracy or authenticity of the content on these sites.

 

Your Content Responsibilities:

You are solely responsible for the content you post on Trademiq. Ensure that your content is original and that you have the right to post it.

We reserve the right to review, refuse, delete, or remove any of your content from Trademiq at our discretion.

You are responsible for creating backups and replacing any content you post.

You agree to indemnify us from any third-party claims arising from your content or conduct.

Note that recording these sessions yourself is not permitted. We may use excerpts from these sessions for case studies, advertising, and marketing purposes.

 

Student Community Support, Notifications, and Messages:

You consent to the use of your contact information for communication, profile customization, and improving your Trademiq experience. Our team may view your profile and monitor your usage for educational support purposes. You agree to receive notifications and messages through various channels, including promotional content.

By accepting these terms, you opt into receiving emails and texts for both transactional and marketing purposes and authorize the use of automated technology for contact. You may opt-out of direct marketing at any time.

Manage your communication preferences in Trademiq under “My Settings” > “Manage Communication”.

 

Data Use for EU and UK Users:

By agreeing to these Terms, users in the UK and EU consent to the use of their personal and sensitive data as defined by EU Data Protection legislation for providing Trademiq access. This includes consent for transferring personal information outside the European Economic Area.

 

Risk Disclosure and Your Responsibility

You recognize and accept that trading and investing inherently involve significant risks, including the potential complete loss of funds allocated to these activities.

You acknowledge that you bear sole responsibility for any trading or investing actions you undertake. Processes and experiences related to trading and investing, as shared on Trademiq's platforms, do not guarantee or predict future profits or losses. They should not be taken as indicative of future performance.

Be aware that future outcomes in trading and investing may significantly differ from those suggested or previously achieved. Past performance is not an indicator of future results.

Your engagement with Trademiq and its services signifies your understanding and agreement with these risks.


Cryptocurrency Risk Notice:

Cryptocurrency investments are highly risky. Several federal agencies have issued advisories regarding the risks associated with virtual currencies.

These are collectively referred to as "Our Intellectual Property." Usage of any segment of Our Intellectual Property in your domain names, websites, or on social media platforms like Facebook, LinkedIn, Twitter, YouTube, Instagram, or in your products or services, is prohibited unless you have our explicit written consent.

Such unauthorized usage may result in confusion and breach our Usage Guidelines. Copying, replicating, or any utilization of Our Intellectual Property must be preceded by our written permission, which we reserve the right to deny.

 

However, in TRADEMIQ-sanctioned private communities on Facebook, you are allowed to use Our Intellectual Property strictly within those approved communities.

  1. The services and content of Trademiq are safeguarded by the maximum protection offered under copyright laws and international treaties. The content available via Trademiq, being a collective work or compilation, is copyrighted.

  2. Reproducing, modifying, creating derivative works, redistributing any part of it, or copying it to another server or location beyond your personal use requires our explicit written approval, which may be withheld at our discretion.

  3. You affirm that your content posted on Trademiq will neither violate any third-party rights (such as copyright, trademark, privacy, publicity, or other personal rights) nor breach any laws. Additionally, your content will not be libelous, defamatory, or otherwise illegal.

  4. You are also responsible for indemnifying us against any third-party claims arising from your use of Trademiq.

  5. We respect your intellectual property rights. Should you believe your rights are infringed upon in Trademiq, notify us at [email protected].

  6. Provide details of the infringing content, your belief regarding unauthorized use, a statement under penalty of perjury about the accuracy of your notice and your ownership or authorization to act on behalf of the copyright owner, your contact information, and your signature.

    You grant us and our affiliates a perpetual, irrevocable, non-exclusive, transferable, worldwide license to use, publish, and republish this Input. If no fees were paid for the use of Trademiq and its services, you are not entitled to any damages from us or our related entities, regardless of the cause of action.

    Please note, some jurisdictions do not allow certain limitations on implied warranties or the exclusion or limitation of liability for damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply, and you may have additional rights.

This action can be taken with or without notice and is subject to the dispute resolution terms of your jurisdiction.

    Your access to Trademiq and its services may be terminated for reasons including, but not limited to:

    (1) violating the terms of service;

    (2) breaking laws, regulations, court orders, or government requests;

    (3) infringing on third-party intellectual property rights;

    (4) breaching export or import regulations;

    (5) disrupting or negatively impacting the operation of Trademiq and its services; or

    (6) potentially exposing us, our associates, you, or any community member to legal liability.

    The reasons listed for possible termination are examples and do not limit our ability to modify, restrict, or terminate your access for any other action we deem illegal, inappropriate, or harmful to Trademiq and its services.

    Additionally, your access may be suspended or terminated if you fail to meet the payment obligations outlined in your Enrollment Agreement or other payment terms for Trademiq services.

    You agree to indemnify and hold harmless us and our related entities from any losses arising from your use of Trademiq, the content you post, your conduct, or any violation of these terms or applicable laws and regulations.

    This indemnification obligation will continue even after the termination or cessation of your use of Trademiq and its services.

    However, contributing members who comply with the Trademiq terms will not be held responsible for indemnifying Trademiq against claims made by other club members.

     

    General Terms Overview

    1. Usage Rights: Your rights to use Trademiq and its services cannot be assigned, transferred, or bequeathed to anyone else without our explicit written consent.

    2. Communication: Communication between you and us can be conducted via traditional first-class mail or email. These communications are considered effective on the date they are received. You can reach us at [email protected].

    3. Publication of Reviews: You are free to publish reviews or assessments about our goods, services, or related conduct. However, any publication within Trademiq must adhere to these Terms, and we are not obliged to publish or host any such content.

    4. Non-Waiver of Rights: Our failure to exercise or enforce any right or provision in these Terms does not constitute a waiver of such right or provision in any circumstances.

    5. Validity of Terms: If any part of these Terms is found invalid, the remaining sections will continue to be effective. Any unlawful or unenforceable provision will be considered separate from these Terms and will not affect the validity of the remaining provisions.

    6. Acceptance of Terms: By using Trademiq and its services, you acknowledge and accept these Terms. If you disagree with these Terms, you have the option not to use Trademiq.

    7. Dispute Resolution and Mandatory Arbitration for USA Users: It's important for USA users to review this section as it affects your legal rights. In the case of disputes, we encourage satisfaction and productivity within our Community and provide a framework for dispute resolution.

      Definitions: For the "DISPUTE RESOLUTION AND ARBITRATION" section, “TRADEMIQ” refers to Safegate Advisors SRL.

      Government Reporting: These arbitration provisions don’t prevent you from reporting or filing claims with governmental agencies like the Romanian Financial Services Authority or Bucharest Stock Exchange. Federal administrative agencies can still adjudicate and award remedies for claims.

      Good Faith Negotiation: In case of disputes related to this Agreement, your enrollment, or use of the Community, both parties agree to attempt resolution through good faith negotiation before initiating formal dispute resolution.

      The complaining party must provide written notice of the dispute, followed by a discussion meeting, which could be in-person, or via telephone or video conference.

      If the dispute isn't resolved within 60 days, either party may proceed with arbitration or file a complaint in small claims court, depending on the nature of the dispute.

      Governing Law; Venue and Jurisdiction Overview

  8. Applicable Law: By accessing or using Trademiq and its services, you agree that Romanian law will govern these Terms and any disputes that may arise between you and us, irrespective of conflicts of law principles.

  9. Jurisdiction for Disputes: For any disputes or claims not subject to arbitration, you consent to the exclusive jurisdiction of the state court of Romania. You waive any objections to the jurisdiction and venue of such courts, including arguments related to lack of personal jurisdiction or forum non-conveniens.

  10. Provisions for UK and Other Jurisdictions Users:

    We are not liable for any loss, damage, injury, or death (except for cases of our or our Related Person’s direct injury to you) resulting from the use of Trademiq and its services, or any interactions between users, both online and offline. We do not exclude responsibility for fraud, fraudulent misrepresentation, willful misconduct, or any legally non-excludable matters in your jurisdiction.

    In case of unresolved disputes, mediation will be pursued before seeking other remedies. For UK users, mediation will follow the Centre for Effective Dispute Resolution's model, while users in other jurisdictions will use a recognized local mediation service.
